We value the safety of our on-site staff and guests, and I wanted to send out this brief update and commitment towards safe practices in our law offices. While there are many questions during these somewhat chaotic times, there are some safe practices to which we all can adhere to minimize the risk of exposure to COVID-19 (“Coronavirus”). Our offices are committed to these safe practices to minimize the risk of exposure to this potentially hazardous illness. Through working with our title insurance partners and keeping consistently updated on developments in our business, we have determined a plan to keep operations as close to “business as usual” as possible. While a statewide “Judicial Emergency” was signed into effect yesterday by Chief Justice Harold D. Melton outlining that “to the extent feasible, courts should remain open to address essential functions…,” court closures or partial court closures are still possible. Our title insurance partners have released memorandum stating that closings may not occur if the courts are unable to record documents.

To this end, we are implementing electronic recording effective immediately. This change will be permanent and extend past the anticipated Judicial Emergency end date of April 13th, 2020, and should prevent any delays in anticipated closings during these uncertain times. Sanitary Practices (from our expert health care consultants)Temporarily No Candy Dishes- To minimize the spread of hand-to-object-to-hand viral transmission, we will temporarily be removing candy dishes from our closing offices. While we hate taking away a staple of our fun office visits, this was an absolute must from our consultants.

Sanitizing Rooms Between Closings- Between closings, we will sanitize all surfaces and sitting areas in our closing rooms. Hand Sanitizer- We will provide hand sanitizer in our lobby areas. Mail-away Fee to Sellers Waived- our normal mail-away fee for all sellers will be temporarily waived. We cannot waive the cost of overnight labels to return original documents that our office provides, but all other fees associated with mail-away closings to Sellers will be waived. JCash Closings- We are proud to be able to offer cash buyers the option to electronically sign all of their closing documents through our secure portal. This service is free of charge and can be done completely remotely. Pens- Because blue pens are required at all closings, we will be supplying “fresh” pens to each closing so that our guests will not be reusing potentially contaminated pens.

As always, please feel free to take our pens with you. Social Distancing and our Workplace Commitment- Because we are heavily a technologically friendly workplace, our state of the art closing software and systems allow for many of our staff to work from home. In that regard, we have already taken measures to restrict all non-essential site staff to work from home. Because this has been our practice in large regards already, our clients can expect the same efficient work product they have come to expect from Pacific Law Group.

COVID-19 EXECUTIVE ORDER ON REMOTE NOTARY CLOSINGS https://pacificlawllc.com/covid-19-executive-order-on-remote-notary-closings/ https://pacificlawllc.com/covid-19-executive-order-on-remote-notary-closings/#respond Tue, 14 Apr 2020 17:58:30 +0000 https://pacific.sugarfive.digital/?p=566 Yesterday Governor Kemp signed an Executive Order that temporarily removes the requirement that the “attestation of a recordable instrument under Code Sections 44-2-1 et seq. and 45-17-1 et seq. must occur in the physical presence of the notary public may be satisfied by the use of real-time audio-visual communication technology or any similar real-time means of electronic video conferencing that allows the parties to communicate with each other simultaneously by sight and sound.”This Executive Order also extends to the witness requirement for attested documents. What does this mean for closings going forward?The answer is, it depends. While the Governor has the authority to lift these requirements at the state level, there are several other interested parties regulating a closing including the lender (if any), the State Bar Association who is the state licensing board for attorneys, and the company issuing the title insurance for the lender and the new buyer. The Georgia Bar has endorsed “virtual closings” by temporarily removing such practice as an ethical violation. This means, following approved protocol of the title insurance companies and the lenders, remote signings can happen. What makes the most sense?Sellers have very few documents to sign for a real estate closing. Sellers pre-signing documents is both legal and encouraged. For these reasons, during this health state of emergency, Seller signings are a perfect fit for this approved virtual closing process. Buyers on CASH closings can electronically and securely sign all documents for cash closings without being virtually present or recorded. Because many lenders we have spoken with are NOT authorizing the use of remote online notaries for their borrowers to sign loan packages, we strongly encourage borrowers to still plan to attend closings in person. For those lenders who do approve remote online notary signings, we must either:1.) Have the loan package the day before disbursement (the day before the scheduled closing date); or2.) Have permission from the lender to fund on copies of the executed loan documents; or3.) Have permission from the lender to close “in escrow” pending the receipt of the original mailed returned documents at our law office. For any party, Seller or Buyer, to use the remote online notary service:1.) They must have the ability to print the documents at their current location; and2.) They must be physically located in Georgia. 3.) They must have access to a desktop or laptop with camera and audio capabilities, as well as a scanner so we can verify all docs are signed correctly, and get funding docs over to the lender if necessary. As you can see, this is a new process, one which Pacific Law Group has already vetted in other states, such as Florida, who already have had such processes in place. We have been prepared through business ties in these other states should such process be approved in Georgia. Even still, there will be questions and kinks to work out with the process in Georgia. We are here for our clients during these tough times and will coordinate whenever possible to minimize exposure and accommodate the needs of our clients. -Justin Pacific

So happy for him and his family!
Every client experience is different. The client before this we put a contract on the first house they saw. This one took a few tours over 6 months to find the right one.

I always say you’ll know as soon as you walk through the door if it’s the one & it’s held true every time. Whether it’s the first one on the first day or the 50th one 6 months later, I love the process of them all! I just love getting the opportunity to be a part of it!

I went into it not knowing what to expect & trusting in God to lead the way & He has provided so much!! I’ve met some amazing people & developed relationships that will last a life time! I’m so thankful for everyone that has instilled confidence in me.
